Acceptance of Terms
By accessing or using the Pure Rhythm mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Derrick Emery ("we," "us," or "our"). If you do not agree to these Terms, do not use the App.
Medical and Health Disclaimer
The App is a tracking and organizational tool, not a medical or healthcare service. The App does not provide medical advice, diagnosis, treatment, or personalized health recommendations. You are solely responsible for the supplements you choose to take, the dosages you track, and any resulting health outcomes. Always consult with a qualified healthcare provider before starting, changing, or stopping any supplement, vitamin, or dietary routine. We are not liable for any personal injury, adverse reactions, or health issues arising from your use of the App or the supplements you track.
Data Storage and Google Drive Integration
Unlike traditional applications, the App does not store your tracking data on our servers. Instead, the App requests permission to create and manage a specific Google Sheet within your personal Google Drive account. By using the App, you acknowledge that your data is subject to Google’s Terms of Service and infrastructure uptime. You are entirely responsible for the security of your Google Account. We are not liable for any data loss, corruption, or unauthorized access that occurs if you modify, delete, or lose access to your Google Drive or the specific spreadsheet the App utilizes.
User Responsibilities and Conduct
You may use the App only for lawful purposes. You are responsible for the accuracy of the data you input into the App. You agree not to misuse the App, reverse-engineer its systems, attempt unauthorized access, or use it in any way that violates the Google API Services User Data Policy or could harm us, other users, or third parties.
No Warranty
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, completely secure, or that your Google Drive connection will never fail.
Limitation of Liability
To the fullest extent permitted by law, we are not responsible for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the App. This includes, without limitation, physical injury, health complications, damage to devices, permanent data loss, business interruption, or any other loss resulting from your reliance on the App.
Third-Party Services
The App relies on integrations with third-party services, specifically Google Drive and Google Sheets APIs. We are not responsible for the availability, content, accuracy, or practices of Google or any other third-party services, and your use of them is governed by their respective terms and policies.
Discover Tab, Product Links, and Affiliate Disclosures
The App features a "Discover" tab that provides links to third-party products, including supplements available on Amazon.com and other sites. These links are provided for informational purposes and convenience only. The inclusion of any product does not constitute a medical endorsement, diagnosis, or a recommendation that you need or should use the product. You must consult with a qualified medical professional before purchasing, starting, or changing any supplement or health product discovered through the App.
Some of the links provided within the "Discover" tab and throughout the App are affiliate links. This means that if you click on the link and make a purchase, we may receive an affiliate commission at no additional cost to you. These commissions help support the ongoing development of the App. We are not responsible for the availability, quality, safety, or efficacy of any third-party products purchased through these external links, and your transactions are governed by the respective third-party retailer's terms and conditions.
Changes to These Terms
We may update these Terms from time to time to reflect changes to the App or legal requirements. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
